- Does receiving care at a VA hospital make me ineligible for an HSA?
- No. This used to be the case, but the Surface Transportation and Veterans Health Care Choice Improvement Act, which became effective January 1, 2016, changed that. Previously, any veteran who receives care at a VA hospital would not be HSA-eligible for 3 months after receiving VA care. Now, veterans who receive care at a VA hospital for service-connected disabilities maintain their HSA eligibility.
IRS Notice 2015-87 distinguishes between services provided by the VA for service-connected disabilities and other types of care by stating that any care received by a veteran with a disability rating will be considered qualifying care.
